End-User License Agreement

Plain summary. This EULA is the contract you agree to when you install the app. It incorporates Apple's standard App Store EULA and adds rules that apply specifically to the only user-generated content we host: your chosen public nickname and the free-text descriptions you add to reports about other players. There is no photo or image upload anywhere in the app. It is between you and Hole in the Roof Studios LLC (the company behind Guess The Plate); Apple is not a party but Apple is a third-party beneficiary entitled to enforce certain provisions.
1. Acceptance
By downloading, installing, accessing, or using Guess The Plate ("the App," "the Service"), provided by Hole in the Roof Studios LLC ("we," "us"), you accept and agree to this End-User License Agreement ("EULA") and to our Terms of Service and Privacy Policy. If you do not accept, do not install or use the App.
2. Apple Standard EULA incorporated
The App is licensed to you under Apple's Licensed Application End User License Agreement ("Apple Standard EULA"), which is incorporated by reference. In any conflict between the Apple Standard EULA and this document, the provision more protective of the end user prevails, except where applicable law requires otherwise.
3. License grant
Subject to your compliance with this EULA, we grant you a non-transferable license to use the App on any Apple-branded device that you own or control, in accordance with the App Store usage rules. This license is for personal, non-commercial entertainment.
4. User-generated content (App Review 1.2 disclosure)
The only user-generated content in the App is your chosen nickname and the free-text descriptions you add to reports about other players. You also choose an avatar from a fixed set of preset avatars we provide. The App has no camera, no photo picker, and no image upload — you cannot submit a photo or any other image. By accepting this EULA you agree to the following user-generated-content rules:
4.1 No objectionable content
You agree that you will not choose a nickname or submit report text that is unlawful, threatening, abusive, harassing, defamatory, hateful, sexually explicit, obscene, violent, infringing of any intellectual property right, invasive of privacy, or otherwise objectionable. You agree that you will not use a nickname or report text that impersonates another person or exposes personally identifying information of others.
4.2 Nickname moderation
Nicknames are screened against a banned-term filter before they are accepted, and we may remove, hold, or reject a nickname or report text at our discretion when we believe it violates this EULA, our Terms, or applicable law. Because avatars are chosen from a fixed preset set rather than uploaded, no image moderation applies.
4.3 Reporting
Every other player you can see carries a one-tap "Report" affordance. We act on reports within a reasonable time. Repeated valid reports against an account can result in suspension or termination. Submitting false or coordinated reports is itself a violation.
4.4 Blocking
You can block another user from a one-tap affordance wherever you see them. A block prevents that user from appearing in your view and prevents them from interacting with you. Blocks are mutual at the data-visibility layer.
4.5 Zero tolerance
We operate a zero-tolerance policy for harassment, hateful conduct, and credible threats of violence. Accounts that engage in such conduct are terminated, and we preserve the associated report records as needed to respond to lawful requests.
5. Voice mode
The voice-input mode uses Apple's on-device speech recognition framework. Audio is processed locally on your device; we do not record, store, or transmit your voice. Apple's Software License Agreement governs Apple's frameworks.
6. In-app purchases
The App offers optional in-app purchases (coin packs, VIP subscription). All purchases are processed by Apple under the Apple Standard EULA and App Store policies. We do not see your payment instrument. Subscription auto-renewal can be managed in Settings → Your Apple ID → Subscriptions. Refund requests go to Apple at reportaproblem.apple.com.
7. Consent to telemetry
You consent to anonymous crash reports and aggregate analytics necessary for product reliability. We do not link these to your identity. Detail in the Privacy Policy.
8. Intellectual property
The App, including its code, graphics, audio, music, dictionaries, preset avatars, and trademarks, is owned by us or licensed to us. The nickname you choose remains yours; see Terms §9 for the license you grant us to host and display it.
9. Termination
This EULA remains in effect until terminated. You may terminate by deleting the App and your account (Settings → Account → Delete my account). We may terminate this EULA if you breach it or fail to comply with applicable law. Sections that by their nature should survive termination (intellectual property, indemnity, limitation of liability, dispute resolution) will survive.
10. Disclaimer of warranties
To the maximum extent permitted by law, the App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express, implied, statutory, or otherwise. We do not warrant that the App will be error-free, uninterrupted, secure, or that it will meet your specific requirements.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the App will not exceed the greater of (a) USD $50 or (b) the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
12. Apple as third-party beneficiary
You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA and that Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary. You and we acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we (and not Apple) are responsible for the investigation, defense, settlement, and discharge of any such claim, to the extent required by the Apple Standard EULA.
13. Export compliance
You represent that you are not located in a country subject to a US government embargo or that has been designated as a "terrorist supporting" country, and that you are not listed on any US government list of prohibited or restricted parties.
14. Changes
We may update this EULA. Material updates will be surfaced on next launch and the "Last updated" date above will reflect the change. Continued use after a change constitutes acceptance.
15. Governing law & dispute resolution
This EULA is governed by the laws of the State of Texas, USA. Dispute resolution is handled per Terms of Service §15 (informal resolution first, then individual arbitration in Harris County, Texas).
