Terms of Service

Plain summary. By using Guess The Plate you accept these terms. The game is provided as-is. You agree not to abuse other players or upload content you don't have the right to share. Apple is your payment processor — refunds go through Apple. Disputes go through informal resolution first; if that fails, individual arbitration. You can cancel any time by deleting your account in-app.

1. Agreement

These Terms of Service (the "Terms") form a binding contract between you and Hole in the Roof Studios LLC ("we," "us"), the company behind Guess The Plate (the "Service"), and govern your use of the Guess The Plate iOS application and this website. By downloading, installing, or using the Service you accept these Terms in full. If you don't accept, don't use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use the Service. Sign in with Apple gates this at the Apple ID level. You must also be legally permitted to enter contracts where you live. If you are using the Service on behalf of an organization, you confirm that you have authority to bind that organization.

3. Your account

Your account is created when you sign in with Apple. You're responsible for keeping your Apple ID secure; we treat anyone signed in with your Apple ID as you. Pick a nickname that doesn't impersonate someone else or violate §5 below. We may release a nickname back to the pool if it has been inactive for an extended period or if it violates these Terms.

4. License grant

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, solely for non-commercial entertainment.

The Service is sold by Apple under Apple's Standard EULA as modified by our supplemental EULA. Apple is not a party to these Terms.

5. Acceptable use

You agree that you will not:

  • Upload, post, or transmit content that is unlawful, sexually explicit, violent, harassing, hateful, infringing, defamatory, fraudulent, or that violates anyone's privacy.
  • Upload photos of other people without their consent, photos of children, or photos containing personally identifying information (license plates that are real and traceable, ID documents, addresses, etc.).
  • Impersonate any other person or entity.
  • Reverse-engineer, decompile, or attempt to extract source code from the Service except where such restriction is forbidden by law.
  • Use bots, automation, modified clients, or any technique to circumvent the in-app economy, rate limits, App Check attestation, or moderation systems.
  • Use the Service to send unsolicited communications, spam, or chain content.
  • Probe, scan, or test the vulnerability of any system or network connected to the Service without authorization.

6. Moderation

User-generated content (profile photos, nicknames, free-text reports) is moderated by a combination of automated systems (Google Cloud Vision SafeSearch for images) and human review when necessary. We may, at our discretion: remove content, suspend accounts, hold accounts for review, or terminate accounts that violate these Terms or applicable law. We may also be required to retain certain content under legal hold (REPORT Act 18 USC §2258A, lawful authority requests) even after account deletion.

If you believe content was removed in error, contact moderation@guesstheplate.com within 30 days. We will review and respond.

7. Reports and safety

The Service includes a one-tap "Report" affordance on user-visible content. We act on reports within a reasonable time. Persistent or coordinated false reporting is itself a Terms violation. If you are concerned that another user is in danger or that illegal content has been posted, follow the in-app report flow and we will take it from there.

8. Purchases, refunds, subscriptions

The Service offers optional in-app purchases (coin packs, VIP subscription, no-ads upgrade) sold through Apple. Payment, billing, and refund decisions are made by Apple under the App Store's policies. We don't process payment data and we cannot issue refunds directly — request a refund at reportaproblem.apple.com.

Subscriptions auto-renew until cancelled in Settings → Your Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period.

9. Intellectual property

The Service, its design, art, music, code, and trademarks are owned by Hole in the Roof Studios LLC (or its licensors). License plate formats depicted in the game are stylized references to public-record state formats and are not real registered numbers. The "Guess The Plate" name, logo, and trade dress are our trademarks. You may not use them without prior written permission.

You retain ownership of any content you upload (e.g. your profile photo). By uploading you grant us a worldwide, royalty-free, non-exclusive license to host, display, distribute, moderate, and back up that content as needed to operate the Service. The license ends when you delete the content or your account — except for content under legal hold (see §6, §11).

10. Privacy

Our Privacy Policy is incorporated into these Terms by reference and explains what we collect, why, how long we keep it, and how to exercise your rights.

11. Account termination and data retention

You may delete your account anytime from Settings → Account → Delete my account. A 30-day grace period applies — re-sign-in within 30 days restores the account fully. After 30 days the server-side cascade runs and personal data is deleted in accordance with the Privacy Policy. Certain data may be retained for legal compliance (REPORT Act §2258A holds, cascade audit per Article 30 GDPR record-keeping, anti-abuse pseudonymized records under Article 17(3)(e) GDPR).

We may suspend or terminate your account at our reasonable discretion if you violate these Terms or applicable law, with notice where feasible.

12. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. Some jurisdictions do not allow exclusions of implied warranties; in those jurisdictions our warranty obligations are limited to the minimum required by applicable law.

13. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) USD $50 or (b) the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, even if advised of the possibility.

14. Indemnity

You agree to indemnify and hold harmless Hole in the Roof Studios LLC from any claim arising out of your breach of these Terms, your content, your misuse of the Service, or your violation of applicable law.

15. Governing law and disputes

15.1 Informal resolution first

Before filing any formal claim, please email legal@guesstheplate.com with a description of the dispute. We will attempt to resolve it informally within 60 days.

15.2 Individual arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration in Harris County, Texas, under the rules of the American Arbitration Association. You and we each waive any right to a jury trial. Class actions and class arbitrations are not permitted.

15.3 Carve-outs

The arbitration agreement does not apply to (a) intellectual property claims either party may bring for injunctive relief, or (b) claims you may bring in small-claims court for individual relief within the court's jurisdictional limit.

15.4 Choice of law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. EU consumers

If you are a consumer in the European Union, you may bring claims in the courts of your country of residence; the arbitration clause in §15.2 does not deprive you of statutory consumer protections. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be surfaced in the app on next launch and the "Last updated" date above will reflect the change. Continued use after a change means you accept the updated Terms. If you don't accept, delete the app and your account before continuing.

18. Severability and waiver

If any provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.
